[I. A Statute For The Election Of Nominators, And For The Nomination Of Pastors To Parishes.]

Whereas by Statute 5 of the General Synod,Preamble. "For the appointment of Pastors to Parishes," provision is made that the Trust of selecting a Clergyman, and nominating him to the Bishop for institution to a vacant cure of souls, shall be vested in Nominators chosen annually by the Diocesan Synod, and by the Vestry of the Parish respectively: And whereas it is further provided by the said Statute, that the number of Nominators for each body, and the time and manner of election, shall be determined by the Diocesan page 52Synod: And whereas it is further provided by the said Statute, that it shall be competent for the Synod of any Diocese, to make provision for enabling any Board of Nominators to delegate their trust:

Be it therefore resolved by the Bishop, Clergy, and Laity of the Diocese of Waiapu, in Synod assembled, as follows:—

1.Number of Nominators. There shall be three Nominators chosen every year by the Synod of the Diocese: and there shall also be three Nominators chosen every year by the Vestry of each Parish.
2.Qualification. Every Nominator must be a Communicant, and resident in the Diocese.
3.Time of Election of Diocesan Nominators. The Nominators to be chosen by the Diocesan Synod shall be elected at the General Annual Meeting of the Synod.
4.Resignation. It shall be lawful for any Diocesan Nominator to resign his office by letter addressed to the Bishop or to his Commissary, and upon the receipt of such resignation by the Bishop or his Commissary, the office of such Nominator shall become vacant.
5.Filling up of Vacancy. When the office of any such Nominator shall have become vacant, the vacancy shall be notified by the Bishop to the Diocesan Synod, or to the Standing Committee of the Synod, who shall elect some fit person to fill the office of such Nominator, until the next General Meeting of the Synod, and shall transmit in writing the name of the person so elected to the Bishop.
6.Election of Parochial Nominators. The Parochial Nominators shall be elected by the Vestry in such manner as to the Vestry shall seem fit, as soon as may be after the election of the Vestrymen of the Parish, at a Meeting to page 53be called for that purpose by the Clergyman, or, in the absence of the Clergyman, by one of the Churchwardens: the convener to preside and to have a casting vote.
7. It shall be lawful for any Parochial Resignation. Nominator to resign his office in writing addressed to the Clergyman of the Parish, or to the Churchwardens, and upon the receipt of such resignation by the Clergyman or by the Churchwardens, the office of such Nominator shall become vacant.
8. When the office of any Parochial Nominator Filling up of Vacancy. shall have become vacant, a meeting of the Vestry shall be called by the Clergyman, or, in his absence by one of the Churchwardens, for the purpose of electing a suitable person to fill the office of such Nominator; the convener to preside and to have a casting vote.
9. When any persons shall have been elected Notice to Bishop. to be Parochial Nominators, the Clergyman, or the Churchwarden who presided at the Meeting of the Vestry, shall furnish in writing to the Bishop the names of the persons so elected to be Nominators.
10. Upon the occurrence of a vacancy in any Nomination of Pastors. Parish, the Bishop having first ascertained that sufficient means are available for the support of a Clergyman, shall cause notice of the vacancy in such Parish to be given to all the Nominators, that they may proceed to nominate a Clergyman for institution to the vacant Parish, in accordance with the provisions of Statute 5 of the General Synod.
11. If the Bishop shall reject the Clergyman Rejection by the Bishop. presented to him by the Board of Nominators, and no appeal be made within two months, the page 54Board of Nominators shall again proceed to nominate one or more Clergymen to the Bishop for institution to the vacant cure: Provided that none of the Clergymen who shall have been rejected shall be again nominated without the Bishop's written consent.
12.Delegation of authority to nominate. The trust of nominating a Clergyman may be delegated by the Board of Nominators under the authority of Statute 5 of the General Synod, provided that such delegation be in writing, and be executed by not less than two-thirds of the whole Board of Nominators.
13.Deed of Delegation to be given to the Bishop. If the Board of Nominators should at any time so delegate their trust of nomination, under the authority of the said recited Statute, it shall be incumbent upon them to send the Deed, by which the delegation was effected, to the Bishop, and the Bishop shall thereupon make it known to the person or persons so appointed.
