1874. 2 July.Coromandel District. This Deed made the second day of July one thousand eight hundred and seventy four between Maihi Te Hinaki Hera Puna, Ngakapa Whanaunga and Wiremu Ngawhare Te Hinaki all of Mercury Bay in the District of Coromandel Queens County in the Province of Auckland in New Zealand aboriginal Natives of New Zealand and Kaimarama, Part Of. hereinafter termed the said Natives of the one part and the Mercury Bay Saw Timber Lease to Mercury Bay Saw-Mill Company. Mill Company Limited of the other part, Whereas by a certificate of title duly made and issued under the hand of the Chief Judge of the Native land Court at Auckland and bearing date the tenth day of May one thousand eight hundred and seventy one, a parcel of land at Whitianga in the District of Coromandel containing eight thousand three hundred acres more or less and called or known by the name of Kaimarama was granted to the said Maihi Te Hinaki, Hera Puna, Wiremu Ngawhare Te Hinaki, Interests of Tiepa Puna, deceased, vested in Ngakapa Whanaunga. and one Tiepa Puna their heirs and assigns and whereas the said Tiepa Puna having departed this life intestate and without having made a valid disposal of the said land or any part thereof it was at a sitting of the Native Land Court of New Zealand (held at Kapanga in Coromandel on the seventeenth day of May one thousand eight hundred and seventy one) ordered that the said Ngakapa Whanaunga succeeds to the hereditaments aforesaid, and whereas the Mercury Bay saw Mill Company Limited have agreed with the said Natives for the purchase of the said hereditament hereinafter described at or for the price or sum of Four hundred pounds. Now this Deed witnesseth that in pursuance of the premises and in consideration of the sum of Four hundred pounds paid by the said Mercury Bay Saw Mill Company Limited to the said Natives the receipt whereof is hereby acknowledged, They the said Natives do and each of them Receipt for £400. doth hereby convey and assure unto the said Mercury Bay Saw Mill Company Limited their successors and assigns all that piece or parcel of land at Whitianga in the District of Coromandel in the said Province of Auckland containing two thousand and fifty acres more or less and being part of a block of land called or known by the name of Kaimarama bounded towards the north by lines three hundred links, six hundred and Boundaries. [2,050 acres.] forty three links, and four hundred and sixty links, by the Waiparapara Creek the Whangamororo river by a line Two thousand five hundred and twenty two links, by the Whangamororo block nine hundred and forty one links, by a line one thousand one hundred and eighty eight links, again by the Whangamororo river and by Te Ano block two thousand two hundred and ninety links, towards the East by the Whitianga river towards the South East by lines One thousand one hundred and sixty three links, One thousand and sixty two links, and one thousand one hundred and seventy three links, the Ounuora number one block, One thousand three hundred and sixty two links, Eight hundred and sixteen links, One thousand one hundred and twelve links, One thousand one hundred and sixty links, Eight hundred and eighty two links, One thousand seven hundred and sixty nine links, by a line crossing the Owhiro branch of the Whitianga river aforesaid two thousand one hundred and ninety links, again by the Ounuora number one block Nine hundred and forty links, Six hundred and thirty one links, and one thousand and even links, by the Ounuora block two thousand three hundred and thirty six links, Five hundred and fifty three links, and two hundred and fifteen links, again by the Ounuora block number one three hundred and eighty seven links, six hundred and sixty five links, Eight hundred and twenty six links, one thousand one hundred and forty four links, Five hundred and sixty eight links, and one thousand and sixty one links, towards the south by other parts of the said block ten thousand six hundred links and towards the North West by the Mahakirau block Four thousand two hundred and ninety eight links, and nine hundred and fifteen links, by the Mahakirau Creek, by a stream and again by lines one hundred and ninety nine links, two hundred and thirty six links, three hundred and fourteen links, Four hundred and eight links, Two hundred and twenty nine links, Two hundred and seventy links, Three hundred and seventy four links, Two hundred and fifty one links seven hundred and fifty nine links, Two hundred and eight links, Two hundred and fourteen links, Two hundred and three links, Three hundred and sixty nine links, Three hundred and eighteen links, Three hundred and three links, Two hundred and forty two links, Four hundred and thirty four links, Two hundred and thirty seven links, Three hundred and eighty six links, Two hundred and thirty six links, and one hundred and ninety three links to the commencing point as the same is delineated by the plan drawn hereon with all the rights members and appurtenances hereunto belonging to hold the same unto the said Mercury Bay Saw Mill Company Limited their successors and assigns for ever and the said Natives do and each of them doth hereby for himself his heirs and assigns covenant with the said Mercury Bay Saw Mill Company Limited their successors and assigns that the grant from the Crown of the said piece of land shall and will (inevitable accident alone preventing) from the time the same shall be issued at all times be produced unto the said Mercury Bay Saw Mill Company Limited their successors and assigns for the purpose of widening the title to the said hereditaments but at the request cost of the said Mercury Bay Saw Mill Company Limited their successors and assigns and that at the like request and cost true and attested copies thereof shall be delivered to them and that meanwhile the same shall be kept safe whole and undefaced in Witness whereof the said parties have hereunto subscribed their names.
