Memorandum of Lease.
We Wiremu Kingi Tutahuarangi, Panapa Waihopi, Te Manihera
Maiki, Aporo Matahuata,
1874 27 November.
Poverty Bay District.
Te Motu. Aterata Ruru, Tipene Tuataki, Pera Tutoka, Te Otene te Waka,
Rangikohera,
Lease for 50 years. Wi Mahuika, Arapera Pere, Mereana Paraohe all of the East Coast District
of New Zealand, aboriginal Natives of New Zealand being the holders of a
certificate of title of an estate in fee and hereinafter called the said lessors
subject however to such encumbrances liens and interests as are notified by
memorandum underwritten or endorsed hereon in that piece of land situated in the
said East Coast District of New Zealand containing 68,482 acres be the same a
little more or less being that block of land called or known by the name of "The
Motu Block" bounded on the South East by a line
Boundaries. [68,482 acres.] bearing 238° 53′ dividing the said block from the Poverty Bay ceded
block 105,830 links on the South West by the Koranga River on the North West by
a line bearing 242° 30′ 80,170 links, running from the Koranga River to Moanui
and on to Pokaikiri thence by a line North North East bearing 205° 30′ 23,056
links to Moutohora thence South Easterly by a line bearing 300° 30′ 4059 links
to the Whakapaupakihi River thence along that River to its junction with the
Motu River thence along the Motu River to

Kaitaura thence along the creek to its source thence
by a line bearing 169° 40′ 49,525 links to the Rangiriri River thence to the
said line dividing the said block of land from the Poverty Bay ceded Block as
the same lands are shewn and delineated on the Government map of the said
District and on the plan thereof drawn on these presents, do hereby lease to Her
Majesty Queen Victoria all the said land to be held by her Majesty Queen
Victoria as tenant for the space of Fifty years from the Nineteenth day of
December 1873 at the yearly rental of one hundred pounds for the first five
years of the said term, one hundred and twenty five pounds for the second five
years of the said term, one hundred and fifty pounds for the third five years of
the said term, one hundred and seventy five pounds for the fourth five years of
the said term, two hundred pounds for the fifth five years of the said term, two
hundred and twenty five pounds for the sixth five years of the said term and two
hundred and fifty pounds for the last twenty years of the said term payable on
the nineteenth day of December in every year during the said term, subject to
the following covenants, conditions and restrictions, the lessors shall pay to
Her Majesty Queen Victoria, hereinafter called the said lessee all monies paid
or to be paid by the General Government of New Zealand for the survey of the
said block of land in manner following. The said Lessee shall retain and deduct
out of the rents payable for the said land the sum of Fifty pounds per annum
until the whole of the said monies so paid or to be paid for the said survey
shall be repaid by the said Lessors, Provided nevertheless that no monies for
that purpose shall be retained and deducted out of the said rents until after
the expiration of Ten years from the said Nineteenth day of December 1873. The
said Lessors shall repay to the said Lessee the
Receipt for £300 advance. sum of Three hundred pounds already advanced to them the said Lessors by
John Alexander Wilson Esquire the agent for the Crown negotiating the said lease
of the said lands in the month of December 1873 such sum of Three hundred pounds
to be retained and deducted out of the said rent by the said Lessee at the rate
of Fifty pounds per annum after the payment in full of all monies to be retained
and deducted for survey as aforesaid. Should Gold or Silver be found within the
said boundaries of the said block and the
Kaitaura reserve. [500 acres.] said Lessee shall desire to work the same it shall be lawful for her so
to do paying to the said Lessors the Miners’ Rights at the rate of one pound per
annum for every miner who shall work below the ground on the said block during
the said term or any part thereof. Should Coal Petroleum or any other minerals
be found on the said block the said Lessee shall be entitled to work the same on
such terms as may be agreed upon between the said Lessors and Lessee. The said
Lessee to have the right to all growing and other timber on the said land hereby
demised during the said term and the said Lessee hereby agrees that a Reserve of
Five hundred acres situate at Kaitaura within the said boundaries shall
forthwith be surveyed and set apart for the sole use and benefit of the said
Lessors during the said term of Fifty years as the said Reserve is marked green
on the said plan drawn hereon. It shall not be lawful for the said Lessors or
any of them to sell or otherwise part with the fee simple and inheritance of the
said land or any part or parts thereof to any person or persons other than the
said Lessee during the said term of Fifty years.
We Wiremu Pere otherwise William Halbert of Poverty Bay in the said East Coast
District of New Zealand a half-caste the husband of the above named Arapera Pere
and Wiremu Paraone otherwise William Brown of Poverty Bay aforesaid, a
half-caste the husband of the above named Mereana Paraone do hereby lease ratify
and confirm unto Her Majesty Queen Victoria the above described lands upon the
terms and conditions above set forth expressed and implied.

lease of the above described lands to be held by Her Majesty Queen Victoria as
tenant and subject to the conditions restrictions and covenants above set
forth.
