1875. 1. February.Taupo District.This Deed made the first day of February one thousand eight hundred and seventy five Tuwhancaupoko. Between Rauwiri Tahawai Raharuhi Puritia, Mauparaoa Te Rau, Moihi te Huri, Te Hira Potakurua, Peraniko Ngarimu, Ngawaka Takeke, Horomona Te Aho, Te Tuhi Paraoa, Peraniko Parakiri, Mirima Paretawhio, Matetahuna Te Marama, Paretipua Te Huriwhenua, Rawinia Rangihoea, Peti Maraea, Ihaia te Waru, Manuera Te Tuhi, Pokairangi, Te Paipa Murahuhu, Nikora Whakaumia, Pukarei Tamarakai Marara Pipi, Mere Peka Te Whatarau, Namu te Tuhi Rakapa Peraniko, Harete Peraniko, Roka Repora, Waihuri Ponaka, Moemoe Taruna, Tira Koroheke Ngaawhiawhi, Konaho Hohaia, Himiana Horomona, Ramarihi Te Hau, Ere Peita, Te Wata Horomona, Hau Rawiri, Apiata Tanirau, Horopapera Mauparaoa, Hohaia Peraniko Manaena Te Ariki Wharehuia Te Kahika, Whiripo Parahi, Hapimana Rawiri, Petera Te Rangihiroa, Hiriwanu Rangihuritini, Kemara Te Tuhi, all of the District of Bay of Plenty in the Province of Auckland and Colony of New Zealand Aboriginal Natives (hereinafter called the Lessors) of the one part and Her Majesty Queen Victoria of the other part withesseth that they the said Lessors do and each of them doth hereby demise and lease unto Her said Majesty her successors and assigns, All that piece, or parcel of land at Tuwhangaupoko in the District of Bay of Plenty in the Province of Auckland aforesaid containing by admeasurement from the sketch plan on the margin hereof about Forty thousand acres more or less described in the schedule hereunder written, and delineated on the plan drawn hereon, And all mines minerals timber and profits in or upon the said land Together with all rights easements and appurtenances to the said parcel of land Lease for 30 years. belonging and all rights necessary for the enjoyment of the same To hold the same unto Her said Majesty Her successors and assigns for the term of Thirty years from the fitst day of February one thousand eight hundred and seventy five Yielding and paying therefor during the first ten years of the said term the yearly rent or sum of One hundred pounds, during the next ten years of the said term the yearly rent or sum of One hundred and fifty pounds, and during the last ten years of the said term the yearly rent or sum of Two hundred pounds by even and equal yearly payments on the anniversary days of the date of this agreement of lease in each year, the first of such payments at the rate of one hundred pounds per annum to be made on the first day of February succeeding one thousand eight hundred and seventy five, Provided always and it is hereby declared and agreed by and between the parties hereto that the receipt of any number of the said Lessors for the payment of any rent hereby reserved will be a sufficient discharge for the payment of the same and will be as valid and effectual for all purpoees as it the same had been signed by the whole of the said Lessors. And the said Lessors do and each of them doth hereby for themselves their and each of their respective heirs executors administrators and assigns covenant with Her said Majesty Her successors and; assigns that they the said Lessors or either of them their or either of their heirs or successors shall not nor will during the continuance of the said term hereby created, sell mortgage or dispose of the said land or any part thereof or the title thereto without first obtaining the assent in writing of His Excellency the Governor of the Colony of New Zealand to every such proposed sale mortgage or disposition. In Witness whereof the said parties have hereunto subscribed their names.
