Enclosure 16.Memorandum of Agreement made this Twenty ninth day of October
One thousand eight hundred and sixty nine between the Native Chiefs Te Wharenui
Ngainoka Kereti te Moananui and Herewini of the District of Tauranga in the
Province of Auckland in the Colony of New Zealand of the one part and Messrs.
Whitaker and Russell Solicitors of the City of Auckland on the other part.
Whereby the said Wharenui Ngamoka Kereti te Moananui and Herewini agree to sell
to the said Messrs. Whitaker and Russell, all that piece or parcel of land
situated at the Island of Matakana in the Paetaha. [100 acres.] Province of Auckland in the Colony of New Zealand and known by the name
of Paetaha containing one hundred acres more or less aud the said Messrs.
Whitaker and Russell agree to purchase the said land and to pay to the said
Wharenui Ngamoka, Kereti the Moananui and Herewini at the rate of Four shillings
per acre in manner following, the sum of Five pounds sterling on signing this
agreement and the balance on the completion and execution of a conveyance, and
the said Wharenui Kereti te Moananui and Herewini further agree to have the said
land surveyed without loss of time and to prove their title to the said land in
the Native Lands Court and hand over the certificate to Receipt for £5. the said Messrs. Whitaker and Russell on receipt of the same from Mr. Clarke Cornmissioner. The
receipt of Five pounds sterling is hereby acknowledged received from Mr. John Chadwick on account of
Messrs. Whitaker and Russell.
