1874. 2 April.Bay of Ptenty District.This Deed made the Second day of April in the year one
thousand eight hundred and seventy four, Between Frederick Whitaker of Auckland
in the Colony of New Zealand Solicitor and
Thomas Russell of the same place Solicitor but now on a visit to
England
Island of Matakana. [7,919 acres.] of the one part and Her Majesty Queen Victoria of the other part Whereas
the said
Frederick Whitaker and
Thomas Russell have purchased
from the Native owners various blocks of land situate on the Island of Matakana
in the Harbour of Tauranga as appears by the several agreements specified in the
Schedule to this Deed And Whereas the amount expended by the said
Frederick Whitaker and
Thomas Russell in part payment for the
said land together with interest and expenses amounts to the sum of Eight
hundred and fifty seven pounds. And Whereas the
Honorable Donald Maclean on behalf of the Colonial
Government of New Zealand is desirous of reserving the Island of Matakana for
public purposes and has requested the said

and
Thomas Russell to accept the amount expended by them
in purchasing the said blocks of land and to transfer all their right and
interest to Her Majesty the Queen which they have consented to do Now therefore
this Deed witnesseth that the said
Frederick Whitaker and
Thomas
Russell do hereby assign and transfer to Her Majesty the Queen All the
right title and interest of them the said
Frederick Whitaker and
Thomas
Russell in and to all those several pieces or parcels of land situated
on the Island of Matakana in the district of Tauranga and Province of Auckland
as the same are mentioned or described in the several agreements specified in
the schedule to this deed With all the rights and appurtenances thereto
belonging and also the said several Agreements and all rights claims and demands
thereunder or incident thereto In Witness whereof the said
Frederick Whitaker and
Thomas Russell have hereunto set their hands and
seals.
