This Deed made the Fifteenth day of February One thousand
eight hundred and sixty
1862. 15 February.Waipa District. two Between William Chitham of Tomo in the District of Waikato and
Province of Auckland in the Colony of New Zealand Settler of the first part and
William Gisborne
Otawhao. Esquire Under Secretary for the Colony of New Zealand of the second part
Witnesseth
Lease for 2 years at £50 per annum. that in consideration of the Rent hereinafter reserved and the covenants
and powers herein contained and implied by virtue of the Conveyancing Ordinance
No. X of Session II. He the said William Chitham doth demise and lease unto the
said
William Gisborne and his
Executors Administrators and Assigns in trust for Her Majesty for the use of the
Government of the Colony of New Zealand All that parcel of Land in the said
Province containing by admeasurement Twenty eight acres two roods and seventeen
perches more or less situated at Rangiaohia bounded on the North by a line Two
Boundaries.[28a. 2r. 17p.] thousand seven hundred and five links On the East by a Road from
Rangiaohia to the Puniu River and a line six hundred and twelve links On the
South by the Kie Kie Swamp to a Matai tree and thence by a line to the Oruapaha
Swamp Six hundred and seventy links And on the West by the Oruapaha Swamp
aforesaid as the same is delineated on the plan drawn in the margin hereof
Together with all that Messuage or Dwelling house and outbuildings thereon
standing or being and all the rights and appurtenances to the said premises
belonging To hold unto the said
William
Gisborne and his Executors Administrators and Assigns in Trust for Her
Majesty and Her Successors for the use of the Government of the Colony of New
Zealand from the First day of February One thousand eight hundred and sixty two
for and during the Term of Two years Yielding and paying therefor yearly and
every year unto the said William Chitham, his Heirs and assigns the annual rent
of Fifty pounds Sterling by equal quarterly payments on the first days of
February May August and November in each year without any deduction whatever and
it is hereby declared and agreed by and between the said parties hereto that the
lessee shall not be liable for loss by fire And the said
William Gisborne doth for himself his Executors
Administrators and Assigns hereby Declare that he and they shall and will stand
and be possessed of and interested in this Lease as Trustee or Trustees only for
Her Majesty for the use of the Government of the Colony of New Zealand In
witness whereof the said parties have hereunto set their hands the day and year
first above mentioned.
