No. 745.—Petition of Apihai Tango and 62 Others.

Petitioners pray that the decree of the Gisborne Validation Court in regard to the Whangara Block may be removed from the table of the House, in order that an appeal may be lodged against the decision.

I am directed to report that the case is a most complicated one, and is now, on various law points, on appeal to the Appeal Court; that the Committee cannot at this time of its sittings investigate the allegations in the petition; and they therefore recommend that the petition be forwarded to the Government for consideration, and to decide whether the power granted by section 16 of "The Native Land (Validation of Titles) Act, 1893," should be exercised by either not confirming the decree or removing it from the table of the House, as asked by the petitioners.
