Memorandum relative to the Hostelry Reserve at Port Lyttelton, Province of Canterbury.

The history of the case is as follows:—At a general meeting of the Natives at Lyttelton, in January, 1860, a promise was made by Governor Browne to the Natives at Canterbury, that some accommodation at Lyttelton should be provided for them, and application was subsequently made to the Provincial Government, through Mr. Buller, to know whether they would contribute either in land or funds for the object proposed. The Provincial Government, however, declined, on the ground that, as the control of all Native matters had been specially assumed by the General Government, it was more a matter for their attention.

In June, 1863, the General Government, through Mr. Hamilton, purchased Section No. 232, Dampier Bay, for £250, from a Mr Thomas Hanmer, and after some delay in getting satisfactory specifications for the erection of a suitable building, Mr. Hamilton in 1864, was authorized to incur an expenditure of £250 for that purpose. A building was subsequently erected at a cost, including commission, of £222. A further sum of £20 was authorized in 1865, to provide water tanks and other necessary additions to the building, making a total cost, including other incidental expenses, of about £500.

In June, 1865, Mr. Commissioner Brown reported that the building was finally completed and ready for occupation.

It would seem, however, that notwithstanding the desire expressed by the Natives in the first place to obtain a building of the kind, they have made very little use of it, alleging as an excuse that it is inconveniently situated, and recently a proposition has emanated from some of the resident Natives, that the place should either be let or sold.

Subjoined are copies of the conveyance of Section No 232, Lyttelton, from the Canterbury Association to Mr. Hanmer, and the subsequent conveyance by Mr. Hanmer to Her Majesty Queen Victoria.

Copy of the Conveyance of Section No. 232, Godley Quay, Lyttleton, by the Canterbury Association, to Thomas Hanmer, Esq.

This Deed made the 18th day of October, in the year of our Lord, 1851, Between the Canterbury Association, incorporated by Her Majesty's Royal Charter, bearing date at Westminster, the 13th day of November, in the 13th year of Her reign, by the name and style of "The Canterbury Association for founding a Settlement in New Zealand," now called "The Canterbury Settlement" of the one part, and Thomas Hanmer, of Lyttelton, in the said settlement, Esquire, of the other part. Whereas the Canterbury Association in pursuance of the powers vested in them by their Charter of Incorporation and the Act of Parliament hereinafter mentioned, did on the 7th day of October, instant, put up for Sale by Public Auction at their store in Lyttelton aforesaid, several Allotments or Sections of Town Land situate in Lyttelton and Christchurch, also in the said settlement, and at such sale the said Thomas Hanmer was declared to be the highest bidder for, and Purchaser of the Allotment or page 122Section of Town Land hereinafter mentioned and conveyed for the sum of £14. Now This Deed Witnesseth that the said Association or Body Corporate in consideration of the said sum of £14 to them paid, by the said Thomas Hanmer previously to the execution of this Deed in full, for the absolute purchase of the aforesaid Section of Land hereinafter conveyed (the receipt whereof is hereby acknowledged), and by force of an Act of Parliament, made and passed in the 13th and 14th years of the reign of Her Majesty Queen Victoria, intituled "An Act empowering The Canterbury Association to dispose of certain Lands in New Zealand," and in exercise and in execution of the powers and authorities in the said Act contained and thereby given or delegated, and of all other powers enabling the said Association in this behalf, Do and doth by this Deed or Instrument, in writing under their Duplicate Common Seal, grant, dispose of, and convey Unto the said Thomas Hanmer, and his heirs, All that Allotment or Quarter Acre Section of Town Land, situate in and fronting upon Godley Quay, in the Town of Lyttelton aforesaid, and numbered 232 on the map or plan of the said Association, setting out and describing the said Town of Lyttelton, which said Allotment or Section is more particulary delineated and described by the plan thereof, endorsed on the back of this Deed, Together with the rights and appurtenances to the said Premises belonging, And all the Estate and Interest of the said Canterbury Association therein and thereto, To Hold the said Premises, with the appurtenances, (subject to the Public Roads, Streets, Ways, Outfalls for water, and other Public Easements, Privileges, and Liberties, affecting the same, if any), Unto and To the Use of the said Thomas Hanmer, his heirs, and assigns, for ever; And the said Thomas Hanmer hereby declares that no Widow of his shall be entitled to Dower out of the said Premises, And it is expressly agreed that no Covenant whatsoever shall be implied in this Deed, In Witness whereof the Duplicate Common Seal of the said Association is hereunto affixed, and the hands of John Robert Godley, of Lyttelton, aforesaid, Esquire, and William Guise Brittan, of Christchurch, aforesaid, Esquire, Two of the Attornies by the said Association appointed for the execution of Deeds and Conveyances of Lands within the said settlement and other purposes authorized by the said Act, and both of whom are now actually within the said Settlement, as also the hand of the said Thomas Hanmer, are respectively hereunto set and subscribed, the day and year first above written.

Copy of the Conveyance of Section No. 232, in the Town of Lyttelton, New Zealand, by Thomas Hanmer, Esq., to Her Majesty the Queen.

This Deed, made the 3th day of June, 1863, Between Thomas Hanmer, of Talgai, Warwick, in the Colony of Queensland, Gentleman, of the one part, and Her Most Gracious Majesty Queen Victoria of the other part, Witnesseth that in consideration of £250 sterling, paid by Her Majesty to the said Thomas Hanmer, the receipt whereof is hereby acknowledged, He the said Thomas Hanmer, doth hereby convey and assure unto Her Majesty Queen Victoria, her heirs and successors. All That piece of land, containing one quarter of an acre, situate in and fronting upon Godley Quay, in the Town of Lyttelton, in the Province of Canterbury, in New Zealand, which said section of land is numbered "232" on the official map of the said town, and is particularly delineated on the plan drawn in the margin of these presents. With all the rights and appurtenances thereto belonging, To Hold the same in trust for the site, erection, and maintenance of a Native Hostelry, or such other purpose as the Governor of the Colony may from time to time direct by writing under his hand.
