A Bill IntituledAn Act to validate certain Marriages between Aboriginal Natives of the Colony.
Whereas a number of marriages have heretofore been contracted between persons of the aboriginal native race within this colony, which, though the marriage ceremonies have been performed before persons duly authorized under the law to perform the same, are regarded as of doubtful validity, because of noncompliance with certain requirements of the marriage laws in force within the colony: And whereas it is desirable to remove such doubts, and also to make provision for future marriages:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
The Short Title of this Act shall be "The Native Marriages Validation Act, 1877."In the construction of this Act the word "Native" shall mean an aboriginal native of the Colony of New Zealand, and shall include all half-castes and their descendants by Natives.Every marriage heretofore celebrated between Natives, where the marriage ceremony shall have been performed by any person who at the time was duly authorized by law to celebrate marriages, shall be deemed and taken to be, and to have been from the time such ceremony was performed, valid and binding, notwithstanding that any other requirements of the marriage laws then in force may not have been complied with.Every marriage hereafter to be celebrated between Natives shall, if the ceremony be performed before some person duly authorized to celebrate marriages, be valid and binding, without any further or other compliance with the marriage laws which may then be in force.
