New Zealand: Acts affecting Native Lands, 1886, 1888-91 and 1894-95

Whereas by an inquiry, held under a Royal Commission issued Preamble. under the hand of His Excellency the Governor, dated the twelfth day of May, one thousand eight hundred and eighty-six, into the cases of all half-castes in the Middle Island whose names are not included in any Acts of the Legislature who may still be unprovided with land, it has been ascertained that the persons named in the Schedules A and B hereto are persons who come within the definition aforesaid: And whereas certain names have been erroneously stated in other Acts, and it is necessary to rectify such errors: And whereas it is expedient that an Act should be passed to authorise the setting-apart of land on behalf of the aforesaid persons, and any other members of the same race who may have been subsequently ascertained to have been omitted, in fulfilment of certain promises made in favour of the half-caste families on the cession of the Ngaitahu and Murihuku Blocks by the aboriginal owners to the Crown; and also to give the Governor power to do, execute, and perform all the necessary acts, deeds, matters, and things that may be necessary to execute and perform in fulfilment of the intention of this Act:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1.The Short Title of this Act is "The Middle Island Half-caste Short Title. Grants Act, 1888."
2.For the purpose of carrying out this Act the Governor from Grants of land may be made to half-castes not yet awarded land. time to time may execute warrants for the issue of Land Transfer certificates of title to any of the half-caste persons named in the Schedules hereto, or to their legally-appointed successors, either in severalty or as tenants in common of such portions of Crown lands page 60situate in the Middle Island as may be selected or set apart by any person whom the Governor may authorise in that behalf; and may impose such restrictions or conditions, to which the title under any such certificate shall be subject, as he may deem advisable, and may fix thereon the dates on which the legal estate therein shall respectively vest, and may at any time, and from time to time, make Proclamation of the lands set apart for the purposes of this Act; and all lands described in any such Proclamation shall from the date thereof respectively be deemed to be permanently reserved for such purposes: Provided that the area to be granted under this Act shall not exceed ten acres to each male and eight acres to each female, excepting as hereinafter provided.
3.Amended awards of land to certain persons. The Governor may, notwithstanding anything contained to the contrary in any previous Act or this Act as to the limitation of the area to be granted, allocate and grant to the persons named in Schedule C to this Act the area set opposite their respective names.
Schedule A of "The Middle Island Half-caste Grants Act, 1883," is hereby amended by the omission therefrom of the names and figures following, that is to say,—

4.Erroneous names corrected. Schedule B to "The Middle Island Half-caste Crown Grants Act, 1877," is hereby amended by the omission therefrom of the name of David Pratt, and the substitution of the name of John Pratt in lieu thereof.

Section twenty-three of "The Special Powers and Contracts Act, 1880," is hereby amended in the second paragraph of the second column by the omission of the name of Thomas Leach, and the substitution of the name of Thomas Leitch in lieu thereof.
