This Deed1873 5 December.Kaipara District.Pouto. made the Fifth day of December in the year one thousand eight hundred
and seventy three Between Heta Paikea, Eramiha Paikea and Pairama Ngatahi all of
Kaipara in the Province of Auckland in the Colony of New Zealand Aboriginal
Natives of the said Colony of the one part and Her Majesty Victoria by the Grace
of God of the United Kingdom of Great Britain and Ireland Queen Defender of the
Faith of the other part Whereas Paikea te Hekena of Kaipara aforesaid Aboriginal
Native and Pairama Ngatahi aforesaid party hereto being under and by virtue of a
Certificate of Title ordered to be issued by the Native Land Court of New
Zealand at a Court holden at Helensville in the District of Kaipara and Province
of Auckland fourth day of August one thousand eight hundred and seventy three or
otherwise seised in fee simple in possession as tenants in common of or
otherwise well entitled to the Land hereinafter mentioned contracted with John
Rogan Esquire a Judge of the aforesaid Native Lands Court acting on behalf of
Her said Majesty for the absolute sale to Her said Majesty of the said Land for
the price or sum of Fifty pounds And whereas at or about the time the said
contract was entered into the purchase money aforesaid was actually paid
Receipt for £50. by the said
John Rogan to
the said Paikea te Hekena and Pairama Ngatahi as is hereby acknowledged And
whereas the said Paikea te Hekena departed this life intestate before the
completion of the Conveyance of the said Land And whereas at a sitting of the
Native Lands Court holden at Helensville in the Province of Auckland on the
twenty-ninth day of October one thousand eight hundred and seventy-three it was
ordered that the aforesaid Heta Paikea and Eramiha Paikea ought to succeed to
the estate and interest of the said Paikea te Hekena in the said Land by virtue
of which Order and under the provisions of "The Native Lands Act, 1865," all the
estate and interest in the said land of the said Paikea te Hekena became vested
in the said Heta Paikea and Eramiha Paikea who have agreed to execute the
Conveyance of the same hereinafter contained Now this deed witnesseth that in
pursuance of the said Agreement and in consideration of the said sum of Fifty
pounds paid as aforesaid to the said Paikea te Hekena and the said Pairama
Ngatahi the receipt whereof is hereby acknowledged They the said Heta Paikea,
Eramiha Paikea and Pairama Ngatahi do and each of them doth hereby grant convey
and assure unto Her said Majesty her successors and
Boundaries. [10 acres,] assigns All that piece or parcel of Land containing by admeasurement Ten
acres more or less called "Pouto" situate at Te Wairoa in the District of
Kaipara in the Province of Auckland aforesaid Bounded towards the north-east by
the Wairoa River towards the East by the said River towards the south by a line
Four hundred and seventy-nine links towards the south-west by a line One
thousand three hundred and eighty-eight links, and towards the north-west by a
line Four hundred and sixty-nine links As the same is delineated in the plan
drawn hereon edged red Together with the actual or reputed appurtenances and all
the estate and interest of them the said Heta Paikea Eramiha Paikea and Pairama
Ngatahi and of each of them therein To hold the same unto and to the use of Her
said Majesty her successors and assigns for ever In Witness whereof the said
parties have hereunto subscribed their names.
