1874. 12 February.This Deed made the Twelfth day of February one thousand eight hundred and seventy Whangarei District. four Between Arama Karaka of Otamatea in the Province of Auckland in the Colony Mangawai, of New Zealand an Aboriginal Native of New Zealand of the one part and Her Majesty allotment 122. the Queen of the other part Witnesseth that in consideration of the sum of One Receipt for £150. hundred and fifty pounds paid by Her Majesty The Queen to the said Arama Karaka the receipt whereof is hereby acknowledged He the said Arama Karaka Doth hereby convey and assure unto Her said Majesty her heirs and successors All that the right title estate and interest of him the said Arama Karaka of in and to all or any part or parts of All that parcel of land in the Province of Auckland in the Colony of New Zealand containing by admeasurement Three thousand four hundred and fifty seven acres more or less situated in the Parish of Mangawai in the County of Marsden and Boundaries. [3,457 acres.] being Allotment number One hundred and twenty two Bounded on the North West by lines Nine thousand eight hundred links and Five thousand four hundred and fifty links on the North East by lines Ten thousand links and Thirteen thousand and sixty links and Four thousand links and by the Northern branch of the Mangawai River on the South East by lot number six and by a line by a road and by lots numbers One hundred and eighteen One hundred and seventeen and One hundred and twenty one Twenty seven thousand five hundred and fifty links and on the South West by a road and by a line Sixteen thousand links As the same is delineated on the plan drawn in the margin hereof With all the rights and appurtenances thereunto belonging To hold the same unto Her said Majesty the Queen her heirs and successors for ever And the said Arama Karaka Doth hereby remise release and quit claim unto her said Majesty All the right title claim and demand of him the said Arama Karaka by native custom or otherwise which he the said Arama Karaka hath or may have or if these presents had not been executed could claim in or to all or any part or parts of the said land and hereditaments hereinbefore described And all and all manner of actions or suits touching or concerning the same And the said Arama Karaka for himself and his heirs Doth hereby Covenant with Her said Majesty her heirs and successors that he the said Arama Karaka his heirs or assigns or any other person or persons whomsoever for him or in his name any manner of action or suit or any manner of right or title shall not nor will at any time bring prosecute challenge or demand against Her said Majesty her heirs successors or assigns or her or their lands or tenements for or by reason of the said hereinbefore described premises or any part thereof any rent or rents use and occupation damages or demands due to him the said Arama Karaka for or in respect thereof but that he his heirs and Assigns and every of them shall for ever hereafter by these presents be excluded and barred of and from all actions claims and demands whatsoever for in or to the same Provided always and it is hereby declared and agreed by and between the parties hereto that the covenants implied as incidents of conveyances on the part of the Vendors by the Conveyancing Ordinance of New Zealand number ten of session number two or by any matter or thing herein contained shall be and the same are hereby negatived and shall not be implied against the said Arama Karaka his heirs or assigns In witness whereof the said parties have hereunto subscribed their names.
