Memorandum of Lease.

We Wiremu Kingi Tutehuarangi, Rangikohera, Te Manihera Maiki, Panapa Waihopi, 1875. 16 March. Poverty Bay District. Aporo Matahuata, Titene Tutaki, Atareta Ruru, Arapare Pere, Te Otene te Waka, and Waikohu-Matawai Wi Mahuiha being provisionally registered as proprietors of an estate in fee and Lease for 25 years. hereinafter called the said lessors subject however to such encumbrances liens and interests as are notified by memorandum underwritten or endorsed hereon, in that piece of land situated in the District of Poverty Bay containing forty three thousand and four hundred and seventy nine (43479) acres be the same a little more or less bounded towards the North West by the Motu Block one hundred and five thousand eight hundred and thirty (105,830) links, towards the North East by the Rangiriri River and the Waikohu River in an irregular line, towards the South West by the Waikohu Block, thirty six thousand two hundred and ten (36,210) links, towards the South by Native land thirty two thousand six hundred and forty five (32,645) links, fourteen thousand four hundred and forty three (14,443) links, and towards the South West by land belonging to Natives, eleven thousand one hundred and eighty eight (11,188) links and by the Koronga River as the same is shown on the plan drawn hereon, Together with all the rights members privileges and appurtenances to the said piece or parcel of land belonging or appertaining and all timber trees bushes with the exclusive right of felling taking and carrying away the same, do hereby lease to Her Majesty Queen Victoria and Her Successors all the said lands to be held by Her Majesty Queen Victoria and her successors as tenant for the space of twenty five years commencing from the nineteenth day of December, one thousand eight hundred and seventy three at the Rents hereinafter mentioned, for the first five years of the said term at the rent of one hundred pounds per annum for the following term of five years the rent of one hundred and twenty five pounds per annum, for the next term of five years the rent of one hundred and fifty pounds per annum, for the next term of five years the sum of one hundred and seventy five pounds per annum, and for the next and last five years of the said term the sum of two hundred pounds per annum, subject nevertheless to the following covenants conditions and restrictions.

The said lessors hereby expressly covenant promise and agree with the said Lessee, that the Government of New Zealand and its officers duly authorized shall be at full liberty and have full power after the first ten years of the said term to retain out of the rent payable during that period the sum of Fifty pounds a year for six years such deduction to commence on the eleventh year of the said term. And further that the said Government shall also have the power of retaining out of the said rents, all sum and sums of money expended by the said Government on the survey of the above described Block of land and also all charges and expenses attending the same and that until payment thereof that the same shall be charged and chargeable on the said herediments and premises And further that in the event of the discovery of gold or silver on the hereby demised hereditaments and premises, the said Government if it shall appear advisable or desirable shall have full power and lawful and absolute authority without any let suit or hindrance from the said lessors, to work the same on payment to the said lessors of the sum of one pound in respect of every Miner’s Right working under the ground. And further that in case any petroleum or oil springs shall be discovered on the said demised premises the said lessors if thereunto requested, shall enter into equitable arrangements with the said lessees respecting the same. And further that the said lessees shall not during the said term hereby granted sell or otherwise part with the possession or ownership of the said hereby demised hereditaments and premises to any other party than the said Government.

I do hereby accept this lease of the above described lands to be held by me as tenant and subject to the conditions restrictions and covenants above set forth.
