Impersonation

If employed by, means the same as employee of, then section 13 of the N.Z. Security Intelligence Service Act of 1969 is relevant. It reads

Personation—Every person commits an offence and is liable on summary conviction to imprisonment for a term not exceeding 3 months, or to a fine not exceeding $200, or to both, who (not being the Director or an officer or employee of the Security Intelligence Service) describes himself or otherwise holds himself out as the Director or an officer or employee of the Security Intelligence Service, unless he establishes that the manner and circumstances in which he did the act which is proved were such as to raise no reasonable inference that he was describing himself or otherwise holding himself out as being in reality the Director or such an officer or employee.

If Devon Biggs is not a Security Agent as he told Peter Cullen, he is liable to prosecution under this Act. If he is an employee of the Security Service then the question of prosecution does not arise.
