No. 246, 1898.—Petition of Te Hata Hokopaura and 34 Others.

Petitioners pray for rehearing in connection with Maraehako Block.

I am directed to report that, as this petition refers to a case similar to those contained in the petitions of Haka Tautahi and 11 others, Tamati Ru and others, and Erueti Tiketikerangi and 19 others, on which the Committee reported during the session of 1898 (see I.–3, 1898, pages 17 and 20, Appendix to Journals), it should be referred to the Government with a similar recommendation—viz., "That the Chief Judge of the Native Land Court be asked to exercise his powers under section 43 of 'The Native Land Laws Amendment Act, 1895,' in order to determine whether the last judgment is in accordance with what may be settled upon as Maori custom and law."

E inoi ana nga kai-pitihana kia whakaaetia he whakawa tuarua mo Maraehako Poraka.

Kua whakahaua ahau kia ki penei, i te mea e ahua rite ana nga take o tenei pitihana ki nga take o roto i nga pitihana a Haka Tautahi me etahi atu tekau ma tahi, a Erueti Tiketikerangi me etahi atu tekau ma iwa, i ripoatatia nei aua pitihana e te Komiti nei i te tau 1898 (Tirohia I.–3, 1898, wharangi 17 me 20), na reira me tuku atu tenei pitihana ki te Kawanatanga a me pera ano te kupu a te Komiti me tana kupu o tera tau mo nga pitihana e rua kua huaina ake nei, ara, "Me tono te Tumuaki Kai-whakawa o te Kooti Whenua Maori kia whakahaere i nga mana kua tukuna atu nei ki a ia e tekiona 43 o 'Te Ture Whakatikatika i nga Ture Whenua Maori, 1895,' kia ai ai he huarahi e taea ai te whiriwhiri, i haere ranei te whakataunga whakamutunga a te Kooti i runga i nga tikanga me nga ture Maori kaore ranei."
