Reports of the Native Affairs Committee, 1898.

[Nos. 95 and 129.—Petition of Haka Tautuhi and 11 Others, of Ngaitai Tribe.]

Nos. 95 and 129.—Petition of Haka Tautuhi and 11 Others, of Ngaitai Tribe.

Petitioners pray for rehearing in connection with Tunapahore and Kapuarangi Blocks, Bay of Plenty district.

I am directed to report that the Committee is unable to recommend that a rehearing should be granted in connection with these cases; but, in consequence of the contradictory decisions given by the various Courts which have considered the same, it is recommended that the Chief Judge of the Native Land Court be asked to exercise his powers under section 43 of "The Native Land Laws Amendment Act, 1895," in order to determine whether the last judgment is in accordance with what may be settled upon as Maori custom and law.

3rd November, 1898.
