An Act to provide for the Drainage of Agricultural and Pastoral Lands.
[6th October, 1893.
Be It Enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1. | The Short Title of this Act is "The Land Drainage Act, 1893." |
4. | This Act shall apply to all Native lands within the colony, in the same manner as it applies to lands other than Native lands, subject as follows:—
(1.) | Where any Native land is required to be taken for the purposes of this Act, it shall be taken by the Governor under "The Public Works Act, 1882," as amended by sections thirteen and fourteen of "The Public Works Acts Amendment Act, 1887," and section sixteen of "The Public Works Acts Amendment Act, 1889"; and |
(2.) | Native lands shall be rateable for the purposes of this Act in manner provided by Part II. of "The Rating Acts Amendment Act, 1893," and subject to the exemptions therein provided, saving as follows:—
(a.) | Native lands the title to which has been ascertained by the Native Land Court, and of which the occupier, as defined in section eleven of the Act last mentioned, is a Native, shall not be rated to more than one-half of the amount of any rate that may be levied; and |
(b.) | Native lands of which the occupier as aforesaid is other than a Native shall be rated to the full amount of any rate that may be levied, in manner as if such land were not Native land. |
